# Besday Terms of Service Last updated 7 September 2026. These terms apply when you order a video from Besday. Plain English is deliberate: you should be able to tell what you are buying without a lawyer. ## 1. What you are buying You order a video of a chosen length from a Besday creator profile, give us a brief, and we produce and deliver it. Prices are shown before you pay and are charged in US dollars. ## 2. What you may do with your video — commercial usage is included When your order is paid in full, you receive a **worldwide, perpetual, non-exclusive right** to use the delivered video commercially. That includes: - paid advertising, on any platform - organic social media - your website and online store - editing, cropping, resizing, subtitling and making shorter cuts - including the video inside your own advertisements and content There is no separate licence to buy, no expiry date, and no renewal. You may **not**: - resell or redistribute the delivered video on its own as stock footage - license or sublicense the creator profile or its identity to anyone else - claim ownership of the creator profile itself Besday retains ownership of its creator profiles and everything underlying them. What you buy is the finished video and the right to use it. ## 3. Delivery, and the 24-hour guarantee We deliver within **24 hours of your order being ready to start**. An order is ready when payment has been confirmed and we have what we need to begin — the creator, the length, and your brief. The clock ends when we deliver your video. It does not wait for you to approve it, and requesting changes does not restart it. **If we are late** and the delay was not caused by us waiting on you, you may cancel the order for a full refund at any time before we deliver. ## 4. Revisions Every order includes **two revisions**, within the brief you originally gave us. A revision is a change to how we executed that brief — pacing, the order of shots, emphasis, a particular line, the hook or the ending. Some requests are a **new order** rather than a revision: a different creator, a different length, a new creative concept, or a materially different script direction. We will tell you when that is the case, and it does not use up an included revision. **If we got something wrong** — the wrong product, a missing shot, broken audio, a corrupt file, or an execution that plainly does not match your brief — we fix it free, and it does **not** count as one of your two revisions. ## 5. Cancellations - **Before you pay** — cancel at any time, for any reason. - **After you pay, before production starts** — cancel for a full refund. - **After production starts** — production begins immediately because of the 24-hour promise, so we cannot accept a change-of-mind cancellation. - **If we are late** (see section 3) — cancel for a full refund before delivery. - **After delivery** — the order cannot be cancelled; use your revisions. ## 6. Refunds - Paid, production not started: **full refund**. - We cannot fulfil your order: **full refund**. - We miss the 24-hour guarantee and you cancel before delivery: **full refund**. - Your delivered video has an objective problem that is our fault: **we fix it free**, and if we cannot fix it, **full refund**. - Your delivered video matches the brief and you would like it different: use your included revisions. This is not a refund situation. - You have approved the video: the project is complete and final. ## 7. What you give us You are responsible for the material you send us — logos, trademarks, product photos, video, scripts, music, references, and any claims you ask us to make about your product. By submitting them you confirm you have the rights to use them and to let us use them to produce your video, and that any factual or promotional claim you ask us to include is one you can stand behind. We may decline to produce content we believe you do not have the rights for. ## 8. Acceptable use Our Content Policy sets out what we will and will not make. It forms part of these terms. ## 9. Your account You are responsible for keeping your login secure and for activity on your account. Do not share your credentials. ## 10. Payment Prices are shown before purchase. Payment is due in full before production begins. Applicable taxes may be added where required. ## 11. Our liability Besday's total liability to you for any order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses — lost profits, lost revenue, lost business or lost data — arising from your use of a video. Nothing in these terms limits or excludes liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, these terms do not affect your statutory rights. ## 12. Changes to these terms The terms that apply to your order are the terms in force when you paid. We record the version of each policy against your order, so a later change cannot alter what you bought. If we change these terms, the change applies to future orders only. ## 13. If something goes wrong **Talk to us first.** Most problems are solved in a day by email. Write to support@besday.com describing the order and what went wrong, and we will reply within five business days. Please give us thirty days to resolve it before starting formal proceedings — we would rather fix it than argue about it. ## 14. Governing law and jurisdiction These terms, and any dispute arising out of them or out of any order, are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You and Besday agree that the state and federal courts located in Delaware have exclusive jurisdiction over any dispute that is not resolved under section 13. **If you are a consumer resident in the European Union or the United Kingdom**, this section does not deprive you of the protection of the mandatory consumer laws of the country where you live, and it does not remove your right to bring proceedings in the courts of that country. There is no arbitration requirement and no class-action waiver in these terms. ## 15. Cancellation rights for EU and UK consumers If you are a consumer in the EU or the UK, you normally have fourteen days to withdraw from a distance contract. That right does not apply to goods or digital content made to your own specification, which is what a Besday video is. Our own cancellation policy in section 5 gives you a comparable right: you may cancel for a full refund at any time before production starts, and also if we miss the 24-hour delivery guarantee. ## 16. General If any part of these terms is found to be unenforceable, the rest continues to apply. Our not enforcing a term on one occasion does not waive our right to enforce it later. You may not transfer your rights under these terms to someone else without our agreement. We may transfer ours if our business is sold, and your rights are unaffected. These terms, together with our Privacy Policy and Content Policy, are the whole agreement between you and Besday about your order. ## 17. Contact support@besday.com
